OSHA Postpones Electronic Recordkeeping Compliance Date

OSHA announced that it will extend the July 1, 2017 filing date for the electronic submission of the OSHA 300A Recordkeeping Form. OSHA’s announcement did not state the expected extent of the delay.

The agency’s final rule, Improve Tracking of Workplace Injuries and Illnesses was issued in May 2016.  In that rule, employers who met the following criteria were required to electronically submit their 2016 Form 300A by July 1, 2017:

However, two federal court lawsuits by the business community are pending challenging the new rule, and several unions and worker advocacy groups have already petitioned the court to step in and defend the rule. 

The outcome of these legal challenges is difficult to predict.  We will let you know as additional information, including a proposed extension date, is available.
