The Occupational Safety and Health Administration’s (OSHA) maximum penalties are set to rise by 78% as part of the federal penalty adjustments mandated by Congress and signed into law last year. OSHA’s maximum penalties have not increased in 25 years.
On August 1, OSHA’s new maximum penalties will change as follows:
Any citations issued by OSHA after Aug. 1 will be subject to the new penalties if the related violations occurred after November 2, 2015. States that operate their own Occupational Safety and Health Plans must adopt penalties that are equal to or greater than those implemented by Federal OSHA. After this one-time “catch-up” increase is implemented, metalcasting facilities should expect to see OSHA penalties increase annually with inflation.
